Customer agrees to pay 50% of fee up front; the remaining 50% is due at time of completion, prior to delivery of final image files.
Invoices must be paid in USD.
Work will be delivered digitally.
Customer has right to two rounds of major revisions prior to sketch approval, and one round of minor revisions prior to approval of inked lineart.
Any major revisions requested after coloring stage has begun will result in a fee of $10 per hour for time spent on those revisions.
Customer has right to reasonable amounts of minor edits after completion (i.e. minor color changes)
Artist can cancel and refund any order at any time.
Usage of Work for: AI or ML tools, platforms or programs; AI or ML training; NFT minting; blockchain, or similar platforms; is strictly prohibited.
This contract applies to the artist, further called Artist, and person or institution, further called Customer, purchasing from Artist a work of art further called Work. By ordering Work from the Artist the Customer agrees to the following terms and conditions:
All parties are expected to write in a clear, concise and polite manner.
All relevant reference material and requirements should be provided before any work begins or payment is submitted.
Clear communication is required for accurate interpretation of your request.
Customer agrees to contact the Artist in a timely and responsive manner, responding to any requests for comments, clarifications, opinions, validation of progress etc.
Failure to abide by the terms outlined may result in the commission being declined or canceled.
Customer agrees to pay a non-refundable deposit of 50% of the invoiced amount before work will begin. The remaining 50% is due on completion and prior to delivery of final files.
Any other payment schedule, if available, must be mutually agreed upon before work on the Work commences.
Payment will be requested only via Stripe invoicing.
Client warrants they will not issue chargebacks and the refund policy mentioned in Section 8 will be followed.
Customer agrees to pay the total amount specified in USD.
It is the sole responsibility of Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Artist.
Payment is considered as received and completed only when the total invoiced amount has been paid in USD.
Commissions are generally expected to take between 2 weeks and 1 month after initial invoice is paid.
Artist provides progress updates and seeks Customer feedback voluntarily.
If there are any delays and adjustments to timeline, the Artist will inform the Customer.
Customer must first agree to delays and amendments to timeline exceeding 1 month through standard communication channels.
Customer has the right to request partial refunds 1 month after provided deadlines if Work has not been delivered, and there was no agreed upon amendment to the commission timeline.
These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident or any other credibly documented reason for interruption of work.
Completed Work will be delivered digitally via email to the address provided by Customer, after the final payment has been received by the Artist.
Any other method of delivery must be mutually agreed upon before work begins.
It is sole responsibility of Customer to provide a working delivery method. Artist is not responsible for Customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters, or any other technical obstacles outside responsibility of the Artist.
Upon delivery of the Work, it is the Customer's responsibility to store it properly. Loss of Work due to negligence will not be reimbursed by the Artist. Artist does not guarantee that the original copy of the Work will be available in the case that the Customer loses delivered files.
Customer has the right to 2 rounds of major revisions during the sketch stage, covered by the commission price.
Customer has the right to one round of minor revisions during the inking/lineart stage, covered by the commission price.
Revisions due to Artist's negligence are free.
Excessive minor revisions to the point that forward progress on the work has halted will incur additional fees.
Additional major revisions will incur additional fees.
Additional fees for revisions beyond what is covered by the commission price will be charged at the rate of $10 per hour spent on those revisions.
It is up to Artist's discretion as to what constitutes minor and major revisions.
Customer has one round of minor color revisions once Work is complete and invoice is paid in full, prior to delivery of final Work files.
Artist Rights
The Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and work-in-progress on websites, social media, portfolios, public broadcast channels and more.
Customer Rights
Customer receives exclusive, non-transferable usage rights to the Work for personal use. Refer to item 3 below for commercial rights.
Personal use means: display on social media accounts for promotional purposes with no direct monetization such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels.
Customer must not claim Work as their own, and must credit Artist using their social tag/username/link at the instance of display of the Work or permanently on their websites, social media profiles, broadcast channels and so on.
Customer agrees to not edit or modify Work in any way without prior permission from the Artist.
Commercial Rights
Commercial usage rights are not included unless specified in the commission type or listing on the Artist’s websites or as agreed upon.
Commercial rights means usage of Work on streams or any monetized instances, or selling or reselling Work to another party, as a part of any merchandise product, or on another platform.
Additional charges will be required for commercial usage, if not already included in the price of Work, at a rate of 100% the value of the Work.
Usage of Work for the following is strictly prohibited:
AI (artificial intelligence) or ML (machine learning) tools, platforms or programs
AI or ML training
NFT or blockchain minting
Any other, similar platforms
Artist reserves the right to cancel the commission and refund the appropriate amount, based on work completed, at any time.
No refunds are possible after work begins unless initiated by the Artist.
If Artist cannot complete work or there are delays as detailed in Section 4 for unforeseen reasons, the Customer may be eligible for a full refund. If work done up to this point is accepted and used by the Customer, the Artist will provide a partial refund only.
If the Customer ceases contact for more than 30 days, the commission will be considered concluded and no refunds will be issued.
Forcing a chargeback after delivery or after a refund has been denied will result in personal and public block listing. All rights that may have been bestowed in relation to the artwork will be retracted.
Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. Customer will receive partial refund depending on amount of work completed. Artist reserves the right to refuse any service to the Customer in the future.
The Artist and Customer acknowledge that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information), or are incorporated into the deliverables, that will not be visible to the public shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.
Customer indemnifies Artist against claims, losses, damages, and expenses related to Work usage by the Customer, breach by the Customer of the Agreement, or third-party claims.
If Customer’s rights are violated or the Work is not delivered as agreed, Artist will work to remedy the situation first.
Customer is 18+ and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.
Agreement date is upon first inquiry/communication or first transaction.
